Uncontested divorce is a simple and inexpensive way of terminating a marriage. It is how most people divorce. Uncontested divorce offers both spouses a chance to end the marriage quietly and with dignity.

Why it is a Good Idea

The first good thing you are going to notice about uncontested divorce is the cost. No matter what, you have got to face the fact that any money you can avoid spending on lawyers and divorce attorneys is money you can use to live on after divorce or spend on your kids.

However, low cost is not the only advantage of uncontested divorce. Another is the low level of conflict. If you can avoid adding more pain to an already painful process, then why not? An uncontested divorce can offer you just that. And on top of that, it offers you privacy, which is something most couples would want in a divorce.

You want your marriage to end. Do you want the whole world to know about it? An uncontested divorce offers much needed privacy and quiet for both you and your spouse. Note, however, that the agreements the two of you reach in an uncontested divorce and file with the court will become a matter of public record. However, the disclosures you make to each other and the various proposals you discuss while trying to negotiate an agreement do not have to be known by people other than the two of you and perhaps members of your immediate family, if you care to tell them.

When it is Not a Good Idea

When one of you is beating up the other one, an uncontested divorce is not a good idea. The principle behind an uncontested divorce is that both parties are more or less on equal or even footing. If one spouse is beating the other, then there is no way the victim can be placed on even grounds with the former. The victim needs an advocate.

When the parties are unable to talk with each other, an uncontested divorce is not a good idea. If you are determined to go ahead with an uncontested divorce but your spouse is adamant to proceed with it, let alone talk with you, chances are all your efforts up to this point will be put to waste. If you must divorce but your spouse refuses to speak with you, then you have no choice but to serve them with the process and do it the hard way.

When one or both spouses are ignorant about the law or greedy, then an uncontested divorce is not a good idea. Note that it takes both ignorance and greediness. If your spouse is just ignorant but reasonable, then no problem with an uncontested divorce. The same if your spouse is greedy but knows the law, rationality will eventually win out and you and your spouse can probably reach an agreement. However, if you and your spouse are both greedy and ignorant of the law, then there will be some mighty lawyer work needed and an uncontested divorce is out of the question.
